1. Introduction & Acceptance

Welcome to Laxmi Shipping Agency. These Terms and Conditions (“Terms”) govern your use of our website and the provision of our services, including but not limited to customs clearance, freight forwarding, warehousing, and transportation.

By engaging our services or using our website, you agree to be bound by these Terms. If you do not agree with any part of these terms, you must not use our services.

2. Definitions

3. Customs Clearance & Documentation

As Govt. of India Recognised Customs Authorised Clearing & Forwarding Agents[cite: 19], we act as an agent on behalf of the Client. The Client explicitly warrants that:

  • All documents, information, and data provided to the Company for customs purposes are complete, accurate, and authentic[cite: 25].
  • The Client is the legal owner of the Goods or is authorized to possess them.
  • The Goods do not contain any prohibited items, contraband, or undeclared hazardous materials.

The Client agrees to indemnify the Company against any penalties, fines, or legal costs arising from inaccurate or fraudulent documentation provided by the Client.

4. Prohibited Items

Strict Compliance Notice: Laxmi Shipping Agency maintains a zero-tolerance policy for custom-restricted items. We strictly do not accept, transport, store, or process:

  • Illegal narcotics or drugs.
  • Unlicensed weapons or ammunition.
  • Any goods explicitly banned for import/export by the Government of India.

If such goods are found in a consignment, the Company reserves the right to immediately halt services, notify authorities, and the Client shall bear all resulting legal consequences.

5. Liability & Limitations

While the Company exercises reasonable care in handling Client goods, we are not a carrier but an agent. Our liability is limited as follows:

  • The Company is not liable for loss or damage caused by third-party carriers (airlines, shipping lines, truckers), Acts of God, force majeure, or inherent vice of the goods.
  • The Company is not liable for delays caused by Customs Authorities, Port Authorities, or other government bodies.
  • Clients are strongly advised to purchase adequate Marine Insurance for their cargo. The Company does not insure goods unless specifically instructed in writing and confirmed.

6. Payment Terms

Unless otherwise agreed in writing, all invoices for duties, taxes, and freight charges are due immediately upon presentation. The Company reserves the right to withhold delivery of Goods (lien) until all outstanding dues are paid in full.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. [cite_start]Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal[cite: 6].
